Hi. We had a toilet overflow because of a faulty valve or something years ago at that time we ended up having to have a whole remodel done and so of course this last October we put in all new toilets to avoid it happening again when we had our remodel done, we also had some hardwood extended into our main floor bathroom.

They came out and had to adjust our flange and put a new wax seal into that toilet because it wasn’t properly installed.

Well we now have a water leak to our basement from that toilet and the company that redid the work in October is not accepting responsibility for it.

The plumbing company is claiming it’s a catastrophic flood due to a blockage, which is not the case at all.

we have since had two separate companies come out who both believe it was either an improperly sealed situation or the flange being the improper size because it’s not level with the floor.

We have reached out to our homeowners insurance, as the plumbing company said they are not accepting fault.

Our homeowners insurance tells us we should not file a claim with our homeowners insurance that we should file a claim through the plumbing company’s liability insurance, but the plumbing company won’t give me the name of their liability insurance so how do I proceed?

I do have the name of the plumber, but I hate to file a complaint with the plumbers licensing board When the company is really the one who should be liable.

File a small claim court suit. They will respond.

Reach out to your state’s department of consumer protection and see what the process is for filing a complaint against a contractor

You don’t have the right to their insurance information. You do have the right to sue them and they can choose whether to involve their insurance.

You file with your homeowners and make them sue the plumbers insurance co

Absolutely file a complaint with the contractors board. And then file in small claims. Let them know you’re about to leave reviews on Yelp, Google, etc.

Make sure you are documenting with pictures, estimates from the other companies on the cost of the fix, etc.

Once the plumbing co sees that your evidence is overwhelming they’d be foolish to fight it.

I think oftentimes companies figure that most people won’t follow through.

I’m going to guess they don’t have insurance! Who else would/could be at fault.
